General Terms and Conditions (GTC)

These GTC contain the terms and conditions for using the services available on the https://topgunliveshow.com website (hereinafter: "Website"). Please read them carefully before placing an order. By using the Website or placing an order, you accept these terms.

1. Service Provider's Details

The Service Provider primarily offers live event services (flair cocktail show, cocktail catering, mobile bar service), and may also offer trainings/courses and digital content (e-books, video materials).

2. Definitions

  • Consumer: a natural person according to the Civil Code who is acting for purposes which are outside his trade, business or profession.
  • Business/Client: a non-natural person customer, or a natural person acting within the scope of their economic activity.
  • Service: the live event service, training, or digital content provided by the Service Provider.
  • Contract: the legal relationship established between the Service Provider and the Customer – based on an online order, acceptance of an email offer, or a written contract.

3. Scope and Technical Conditions of Services

3.1. Live Event Services

The Service Provider offers a spectacular flair cocktail show, cocktail catering, and mobile bar services. The content of the service will be fulfilled according to the quantity, duration, drink package, and staff detailed in the offer/order confirmation.

3.2. Technical Rider (Sample Requirements)

  • A safe, level workspace (min. 3×4 m), with a safety zone separated from the audience.
  • Indoors, a minimum clear ceiling height of 2.5 m; adequate distance from light fixtures, sprinklers, and decorations due to the throwing of bottles/glasses.
  • 230V power supply for the mobile bar and/or lighting equipment; weatherproof supply for outdoor events.
  • Deactivation of fire and smoke detectors during the performance.
  • Provision of parking and access for loading/unloading.
  • Provision of a covered or alternative location in case of weather risks (wind, precipitation, heat).

A detailed, event-specific rider may be attached to the order/confirmation. The Customer is obliged to ensure these conditions are met.

3.3. Trainings/Courses

These are conducted in-person or online. The topics, duration, and number of participants are specified in the offer.

3.4. Digital Content

E-books, video courses, and other downloadable materials are delivered on a non-physical data carrier. Access is personal and non-transferable. The scope of the right of use is detailed in section 12.

4. Ordering, Contract Formation

  • Orders can be placed on the Website, via email, or by accepting a written offer.
  • The contract is formed upon the Service Provider's written confirmation (an email is sufficient).
  • The confirmation includes the service description, date, location, number of guests, prices, payment and cancellation terms, and any special conditions (technical rider, insurance, permits, etc.).

5. Prices, Payment, Invoicing

  • Prices are indicated as [net/gross]. If prices are shown as net, they are subject to VAT if applicable by law.
  • Upon order confirmation, the Service Provider may request an advance payment/deposit (typically 30–50%). The remaining amount is due before or after the performance, as specified in the confirmation.
  • Accepted payment methods: [bank transfer, credit card, cash, online payment provider].
  • Travel and logistics costs (mileage fee, accommodation, parking, access fees, special permits) may be charged to the Customer as per the confirmation.
  • Invoicing: The Service Provider issues an electronic invoice. In case of late payment, default interest may be charged according to current legislation.

6. Cancellation, Modification

The Customer may cancel or modify the service in writing. The cancellation fees are:

  • More than 60 days prior: 0% cancellation fee, the advance payment is refundable (in the case of a deposit, the rules of the Civil Code apply).
  • 59–30 days prior: 30% of the total fee.
  • 29–15 days prior: 50% of the total fee.
  • 14–4 days prior: 75% of the total fee.
  • Within 72 hours: 100% of the total fee.

Date changes are only possible with the written approval of the Service Provider; any associated costs shall be borne by the Customer.

In case of cancellation due to weather/force majeure, the parties shall primarily agree on a new date for performance; if this is not possible, the settlement will be made after deducting the costs actually incurred.

7. Consumer's Right of Withdrawal/Termination

If the Customer is a Consumer, they are entitled to a 14-day right of withdrawal without justification for distance contracts, according to current legislation.

  • Exception – leisure services for a specific date: The right of withdrawal/termination does not apply to services related to an event provided at a specific time (e.g., cocktail show, catering).
  • Digital content: For digital content not supplied on a tangible medium, the right of withdrawal cannot be exercised if the performance has begun with the Consumer's prior express consent, and the Consumer has acknowledged the loss of their right of withdrawal.

Detailed information on exercising Consumer rights and a model withdrawal form can be found in Appendix 1 of these GTC.

8. Minors and Alcohol Sales

  • The Service Provider does not serve alcohol to persons under the age of 18. The provider is entitled to verify identity.
  • The Service Provider is entitled to refuse service to intoxicated or problematic guests, and for the safety of the event.

9. Venue, Permits, Liability

  • The Customer is responsible for the lawful use of the venue, obtaining necessary permits (e.g., music use, official permits), and the safety of the audience.
  • The Service Provider is responsible for their own equipment and staff, and for complying with prescribed occupational health and safety and fire protection regulations.
  • The Customer is obliged to compensate for any damage caused to the Service Provider's equipment by guests or subcontractors.
  • The Service Provider's liability exists in cases of intentional or grossly negligent damage; they are not liable for indirect damages or loss of profit, unless otherwise provided by law.

10. Complaint Handling, Conciliation

  • You can submit your complaint to catering@topgunliveshow.com or by post to the mailing address in section 1.
  • We will respond to the complaint in writing within 30 days; in case of rejection, we will inform you of the contact details of the competent authority or the conciliation body according to your place of residence/seat and the possibility of initiating proceedings.

11. Performance, Acceptance, Force Majeure

  • The method and time of performance are contained in the confirmation.
  • Force majeure: an unavoidable event beyond the parties' control (e.g., natural disaster, vehicle technical failure, official restrictions, epidemic measures, etc.) that makes contractual performance impossible. In such a case, the parties shall negotiate in good faith on a new performance.
  • The Service Provider is entitled to use a subcontractor, for whom they are liable as if they had acted themselves.

12. Copyright and Use

  • The content available on the Website (text, image, video, logo, design) is protected by copyright.
  • By purchasing digital content, the Customer does not acquire ownership rights; they receive a non-exclusive, non-transferable right of use for personal purposes. Copying, distributing, or reselling the content without the written permission of the Service Provider is prohibited.
  • The use of photos/videos taken at the event may be regulated by a separate declaration between the parties. The Customer warrants that they will obtain any necessary consents from participants (e.g., for marketing use).

13. Data Processing

Details of data processing are contained in the Privacy Policy (a separate document). The Service Provider processes personal data in accordance with applicable data protection legislation.

14. Governing Law, Legal Disputes

  • The contract shall be governed by Austrian law.
  • In the case of consumer contracts, however, the mandatory consumer protection provisions of the state of the consumer's habitual residence (e.g., Hungary) shall remain applicable.
  • The parties shall primarily seek to settle their disputes amicably; if this is unsuccessful, the court competent at the Service Provider's seat shall have jurisdiction, taking into account the mandatory rules applicable to consumer disputes.

15. Miscellaneous Provisions

  • These GTC shall enter into force upon their publication on the Website.
  • The Service Provider reserves the right to amend the GTC; the amendment shall apply to orders placed after its publication.
  • If any part of these GTC is invalid, it shall not affect the validity of the other provisions.

Appendix 1 – Consumer Withdrawal/Termination Declaration (Template)
